These Terms of Service ("Terms") govern your access to and use of the Wisestack platform and services provided by Wisestack, Inc. ("Wisestack"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.
Acceptable Use
You agree to use Wisestack only for lawful purposes and in accordance with these Terms. You must not use the Services to violate any applicable laws, infringe intellectual property rights, transmit harmful or malicious code, engage in unauthorized data collection, or interfere with the platform's operation or other users' experience.
Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. Wisestack is not liable for losses arising from unauthorized account access due to your failure to safeguard credentials.
Subscription and Billing
Paid subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as explicitly stated in your subscription agreement. We reserve the right to modify pricing with 30 days' advance notice. Continued use after a price change constitutes acceptance of the new pricing.
Intellectual Property
Wisestack and its licensors retain all intellectual property rights in the Services. These Terms do not grant you any rights to our trademarks, logos, or proprietary technology. You retain ownership of any data you submit to the platform. You grant Wisestack a limited license to process your data solely to provide the Services.
Limitation of Liability
To the maximum extent permitted by law, Wisestack's total liability for any claims arising under these Terms shall not exceed the amount you paid for the Services in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes shall be resolved through binding arbitration in San Francisco, California, except where prohibited by applicable law.
Changes to Terms
We may update these Terms periodically. We will notify you of material changes via email or in-platform notification at least 30 days before they take effect. Continued use of the Services after changes take effect constitutes your acceptance of the revised Terms.
